Telemarketing Lawsuit

Posted by Howard Gutman | Sep 27, 2024 | 0 Comments

Telemarketers interrupt our peace and work a day but a number of people have obtained compensation for unwanted calls.

Stop Calling my cell, I'm on the Do Not Call List

While many people are annoyed, some secure compensation. One man even used his settlement money to open a bar and named drinks after the telemarketing calls—such as "Car Warranty." How can you file a claim?

1. Document the Claim and Identify the Telemarketer

We have secured over $125,000 in settlements. With a well-supported claim, many companies will settle. Here's what you need to do:

  • Keep a record of all unsolicited calls, including dates, times, and the nature of the communication.
  • Note the phone number and any information provided by the telemarketer.

2. Distinguish Outright Overseas Frauds from Violations of Telemarketing Rules by U.S. Companies

There are various scams involving banks, social security, "phishing," and other frauds conducted by overseas companies. Unfortunately, little can be done about these operations. However, when U.S. companies use telemarketing tools to solicit customers, claims can be filed under laws such as the Telephone Consumer Protection Act (TCPA).

3. Identify the Company Calling

Because they are violating the law, telemarketing companies are often cagey about revealing their name or other information. Sometimes, third parties conduct the initial solicitation on behalf of larger companies.

  • Industries such as solar energy, home remodeling, car warranties, and home improvement frequently use overseas solicitors to secure clients and leads.
  • To identify the company responsible, consumers may need to listen to the solicitation and appear interested without revealing personal information. Once the company reveals its identity, you can proceed with filing a claim.
  • Without proper identification, companies often deny making the calls.
