Mercedes-Benz EQB Battery Recall and Charging Limits

Fire risk, 80% charge cap, park-outside orders, and lemon-law options for 2022–2024 EQB owners.

1. The Vehicle Problem

The Mercedes-Benz EQB is a compact electric SUV on the MFA2 / 243 platform. Propulsion comes from a floor-mounted high-voltage lithium-ion pack (Mercedes designation EB330). On many 250+ models the pack is about 70.5 kWh and uses cells supplied by Farasis Energy (Ganzhou). The pack stores energy, feeds the drive motors through inverters, and is supervised by a battery management system (BMS) that tracks cell voltage, temperature, isolation, and state of charge.

How the part is supposed to work. Each cell is a sealed electrochemical unit. Cells are grouped into modules, modules into the pack. The BMS keeps cells inside a safe voltage and temperature window, opens contactors if it detects a fault, and limits charge current. At a high state of charge the cells are more energetic and less tolerant of manufacturing flaws, current ripple from charging equipment, or mechanical damage.

What failed. Mercedes told NHTSA that early-production Farasis cells can be insufficiently robust at high state of charge. Combined with charging-infrastructure current ripple or pack damage, an internal cell short can occur. A short can cascade into a thermal event and a vehicle fire while driving or parked. Mercedes could not rule the risk out. Interim limits — charge no higher than 80% and park outdoors away from structures — cut usable range and prevent normal garage use. Prior software-only campaigns did not end the risk. The current U.S. remedy is full pack replacement (remedy part A2433406703). Production process changes after July 31, 2024 are said to end the condition on later-built vehicles.

2. Models and Years (2019–2026)

There is no U.S. EQB for 2019–2021. U.S. sales began with 2022. The fire-risk pack campaigns concentrate on 2022–2024. Related EQA models share the 243-platform Farasis pack in other markets.

3. Nature of Complaints

Owner reports cluster around fire-risk letters, range loss after the 80% cap or BMS software, long waits for a replacement pack, sudden shutdowns, and 12-volt / HV isolation faults that look like a dead car.

   r/mercedes_benz — “WARNING EQB FAILURE” (Nov. 2025): a 2023 EQB 300 buyer described dash-light floods and a complete stop 12 days after purchase, three similar failures, about 45 days down, and a lemon-law buyback request. Commenters described multi-month pack replacements and called EQA/EQB/EQC “defective lemons.”

   r/MercedesEQ — “2022 EQB Battery — Long Term Fix?” (Aug. 2025): owners compared notes on charging-power drop after the software update and one poster's 80% range falling from about 191 miles to 157 miles immediately after the flash.

   Mercedes EQ All Electric Forum (mbeqclub.com) — HV-battery malfunction threads: “Stop now. Do not tow,” weeks at the dealer, BMS blamed, full pack replacement invoices in Europe exceeding €33,000 when not warranty-absorbed; separate EQB reports of 12V drain tied to HV insulation / BMS faults.

   Facebook groups (e.g., Mercedes-Benz EQB owner posts): pack replacement demanded after seven weeks / under 800 km; members told Mercedes will not open the pack and waits months for a complete unit.

These are owner accounts, not adjudicated findings. They are useful to show the defect is not theoretical and that software “repairs” often left owners with less range and the same fire letter.

NHTSA Part 573 report 26V073 states a fire risk cannot be ruled out, names Farasis Energy as the cell supplier, estimates 100% of the listed population may have the condition, and records consumer advisories “Park Outside.” Mercedes decided on January 30, 2026 to replace packs from a defined cell production window after concluding earlier software was not enough. Two U.S. post-repair fires were reported in coverage of the third campaign. There is no separate public ODI engineering investigation caption beyond these manufacturer-initiated recalls. Germany's KBA lists related 243-series EQA/EQB actions (tens of thousands worldwide).

5. Class Actions and Litigation

As of this draft, counsel has not identified a certified U.S. nationwide class action limited to the EQB Farasis cell-fire defect. 

   U.S.: older Mercedes electrical / 12V battery class pleadings (for example Jones v. Mercedes-Benz filings concerning other models and TSB-defined electrical defects) are not a substitute for an EQB pack-fire class. Treat them as background only.

   Germany: individual repurchase judgments. Landgericht Stuttgart (Az. 53 O 27/26, July 30, 2026) ordered unwind of an EQA 250+ after software then pack-swap limits; Frankfurt (Oder) similarly treated elevated fire risk as a defect on a used EQA. Firm Dr. Stoll & Sauer has pursued related EQA/EQB claims, including an earlier Dortmund filing over persistent fire risk and advertised-range loss after the 80% / software measures.

   Korea: a separate owner action involving EQE/EQS and alleged Farasis-versus-CATL advertising is not an EQB U.S. class and should not be blended into this page without a clear label.

If a U.S. EQB class is later filed, add caption, court, class definition, and a note that class membership is not a substitute for an individual state lemon repurchase.

6. Warranty, Magnuson-Moss, and Deceptive-Practice Claims

A recall is not a complete legal remedy. Owners still living under an 80% cap, a park-outside order, repeat visits, or a months-long wait for a pack may have individual claims. Results depend on state law, mileage, repair history, and timing.

Express warranty

Mercedes sells a basic new-vehicle warranty plus a separate HV-battery warranty (commonly on the order of 8 years / 100,000 miles, longer in some CARB states). Proof: the written booklet, repair orders showing the same HV/BMS complaint, and the recall letter itself admitting a pack-level defect. A software flash that left the fire risk in place, followed by a third campaign for a new pack, is evidence the first “repairs” did not conform the vehicle to the warranty.

Implied warranty of merchantability

A new luxury EV that cannot be parked in the owner's garage and cannot use the advertised state of charge is a strong merchantability fact pattern. Proof: owner's-manual and window-sticker range figures versus the 80% limit; photos of the park-outside letter; days the vehicle sat unused because the owner had no outdoor parking.

Magnuson-Moss Warranty Act

Federal hook for written-warranty failure. Useful when the state lemon presumption window has closed but the HV warranty is still open, or when the manufacturer delayed a pack that the warranty already covered. Fee-shifting if the consumer prevails is a practical reason to plead it with the state claims.

Deceptive / unfair practices

Theories: advertising full range and indoor parking while internal production data and foreign fire reports existed; representing a software update as a cure after later fires; leaving owners in limbo without a parts date. Proof needs particularity — ads, window stickers, dealer statements, and the chronology in the Part 573 reports (China fires, software campaigns, then pack replacement). Some states require pre-suit notice.
