Four ways an EV battery goes wrong
"Battery malfunction" isn't one problem — it's a label covering several distinct failure modes, each traceable to a different part of the pack or its control system. Recent recalls give a real-world example of each. Microscopic flaws introduced on the factory line — misaligned electrodes, a torn foil edge — can pierce the internal separator and trigger a short circuit, sometimes even while the car is parked and off.
Battery-management software failures
The battery management system (BMS) is supposed to catch cell imbalance and rising temperatures before they become dangerous. When its monitoring logic is flawed, thermal instability can go undetected.
A contactor that overheats or welds shut can cause sudden power loss — or, in rarer cases, arcing and fire.Faults spanning the high-voltage system and power electronics — not always a single cell — can cause abrupt, total loss of propulsion, sometimes with no dashboard warning beforehand.

Degradation and range loss are malfunctions too
Fires make headlines, but the more common complaint is quieter: a battery that loses range far faster than normal wear would explain. All lithium-ion packs degrade gradually — but a pack that drops well below its rated capacity in the first year or two, develops cell imbalance, or won't hold a charge in ordinary weather is arguably defective, not just "used." That distinction matters, because rapid, abnormal capacity loss is one of the battery problems attorneys most often bring under state lemon laws.
Signs a battery issue may be more than normal wear
- Range drops 20% or more below the window-sticker estimate well within the warranty period, with no clear external cause.
- The car has been in for the same battery-related repair three or more times, or out of service 30+ cumulative days.
- The vehicle is subject to an open battery recall and the symptom the recall describes keeps recurring after the fix.
- The dealer or manufacturer can't or won't replicate a documented charging or thermal-management fault.
Lemon Law and Magnuson-Moss
Every state has some version of a lemon law, and most explicitly cover electric vehicles the same way they cover any other new car sold with a manufacturer's warranty. A battery problem can qualify whether or not it's ever been the subject of a formal recall. Typical thresholds are three or more failed attempts to fix the same defect, eight or more total repair visits, or 30+ cumulative days out of service — though the exact number is set state by state. A successful lemon law claim with qualifying repairs can result in a manufacturer buyback, replacement with a comparable vehicle, or a cash settlement.
