There are two pending class actions filed by other firms and it is possible that they could lead to some sort of settlement in the upcoming year or 2025.
1. Vehicle Problems
Chevrolet owners have reported multiple problems with Equinox vehicles, particularly surrounding transmission, engine, and oil consumption issues. One typical problem has been the transmission, with lurching, jerking, erratic performance, and whining noise reported. Others have reported engine problems with the Equinox with complaints including,
- Excessive Oil Consumption
- Engine Stalls/Dies While Driving
- Check Engine Light On
- Lost Power/ Stabiltrack Needs Servicing
- Engine Jerks
- Fuel In The Crankcase
- Running Rough
2. Status of Compensation and Class Actions
Unfortunately because of the age of the vehicles many will find it difficult to secure compensation. Statutes of limitations and warranty restriction may defeat some claims.
Several class actions have been filed. The first settlement was reached in a class action lawsuit over oil consumption in 2010–2013 Chevrolet Equinox and GMC Terrain vehicles. The settlement covered vehicles with 2.4-liter Ecotec engines. However, the date for filing claims has passed and our office is not accepting claims for these models. A consumer could try to argue that she was not aware of the settlement or did not receive notice, though many courts have rejected untimely claims. Additionally if a vehicle was sold used by a dealer, one could try to argue the dealer should have disclosed the problem. Finally, some vehicles may be covered by extended warranties.
Two subsequent class actions have been filed for later models. A claim was filed in Buchholz v GM covering 2015-17 vehicles, and a second covers similar years. Neither has been settled and no right to compensation has been established as of March 1, 2024. However, the Court docket indicates there are settlement discussions.
