CONSUMER FRAUD CLASS ACTION LAWYER
Our office handles class action claims for fraud and deception. When does a case qualify as a class action. Courts use these tests.
A. Class action test common questions of fact
Are there similar issues of fact. A class action seeks to adjudicate the claim of many persons in one action, so the question is whether the claims are factually similiar.
B. Common questions of law
A class action hearing then seeks to determine whether there are common questions of law.
C. Class Action Will be Superior
A class action may provide judicial economy and eliminate the risk of conflicting rulings on the same claim. If the cases are dissimilar it may pose the risk of incorrect rulings. Class actions may more sense for smaller claims since on a larger claim, each person may have a right to be heard.
