Will the GM 6.2 engine claim be settling soon.
A. Probably not, there are a number of procedural and substantive issues. A class action settlement may aggregate over 100 million dollars, involve tens of thousands of owner, and require multiple motions and court hearings. Many class actions will last 3-4 years or more.
Can I take action quicker
A. Our office is handling claims now and since these are individual claims, many can resolve within 90 days.
Q. These vehicles are defective and there is even a recall so why should the cases take so long.
A. Again individually many can get resolved. However a class claim requires not only proof of a problem, but common legal and factual issues. Some cars fail early, some late, some have required multiple repairs, others little, the extent of use or inconvenience may vary. The plaintiff in the class needs to prove there are common issues while GM could point to differences from to owner, year to year, state to state, and suggest a common settlement could undercompensate some and overcompensate others.
Indeed vehicle owners may be notified and given an opportunity to oppose a proposed settlement. If a large figure on an aggregate is proposed but which does not yield a substantial amount on an individual basis, some owners may suggest the class counsel should fight for a better settlement. Again claims may be vary highlighting the challenge of crafting an overall settlement.
Q. Will GM have to buy back all the cars for the original purchase price in a settlement.
Q. That is unlikely. Most settlements have involved monetary compensation, or credits towards new vehicle purchases. GM is not likely to agree to such a settlement annd may context the matter on the merits, for example, saying they are fixing vehicles within the warranty, or on procedural grounds, again argue cases vary.
