KIA SEPHIA BRAKE PROBLEMS AND CLASS ACTION

     

THE PROBLEM

Kia Sephia brakes have shown numerous problems, leading to frequent repair, inconvenience, safety concerns and other problems.  There have been over 250 Kia Sephia brake complaints submitted to the National Highway Traffic Safety Admninistration.   

CAUSES

At least two causes or defects have been identified.  First, the brake pads have shown excessive wear and there is a service bulletin dealing with the material used in the pad.  Secondly, the brake height appears to be incorrect, leading to excessive wear. 

REPORTED OPINIONS

Our office won a reported lemon law case involving  Kia Sephia brakes.  However, care must be taken, in a case with similar allegations (involving another law firm)  the New Jersey Administrative Law Judge determined the proofs were insufficient.

KIA SEPHIA CLASS ACTION

A class action has been filed in New Jersey alleging defects in 1999 and 2000  Kia Sephia brakes.  The class has not yet been certified (approved as a class action by the court).   Most  consumers will do better outside of the class action for these reasons:

    1) class actions frequently take as much as 3-4 years to settle or come to trial, with appeals frequent. 

    2) the aggregate amounts on class actions are usually large, ranging from 100 million to figures in the billions.  However those amounts are divided among 10,000-50,000 plaintiffs, with many class action settlements involving less than $1,000 per plaintiff.  Sometimes, the settlements involve vouchers towards new cars instead of a cash settlement or repurchase.  See In Re General Motors Pick-UP Truck Litigation, 55 F.3d (3d. Cir. 1995) ("the settlement agreement provides for members of the settlement class to receive $1,000 coupons redeemable toward the purchase of any new GMC Truck or Chevrolet light duty truck.").
