DAEWOO DEFECTS AND BANKRUPTCY

Daewoo Cars declared bankruptcy. Our office is reviewing claims against Daewoo dealers. The automobile manufacturer declared bankruptcy and claims in the bankruptcy are difficult, time-consuming, and likely to yield little.  But what of the dealers which provided warranties and sold a defective car.  Here is an overview of possible claims against the dealers.  s.  (Since we are located in New Jersey and New York, we cannot bring claims against dealers in other states). 

Implied Warranty of Merchantability   

The Uniform Commercial Code provides an implied warranty that goods are reasonably fit for their intended purposes.  Buyers may present claims that the vehicles are defective and that the seller has been unable to repair them.

Express Warranty 

One must look to the documents to determine who provided the warranty.  If the dealer provided or adopted same, then the manufacturer's bankruptcy does not eliminate its liability. 

Consumer Fraud

Some courts have accepted theories of unconscionability, or gross unfairness.  One may argue the doctrine applies to a 20,000 vehicle where basic parts are unavailable.
